Posting this as a public service announcement. I am in a state where Delta-8 is fully legal and sold openly. I used it casually — a 25mg gummy a couple evenings a week for about three weeks. Nothing excessive. Felt like I was not doing anything wrong because I was buying a legal product from a licensed shop.
Received a job offer from a company I had been interviewing with for two months. Senior position, significant salary increase. Conditional on passing a standard drug screen.
I stopped using Delta-8 five days before the test, figuring that should be more than enough for something I used casually. I was wrong.
Failed for THC.
I explained to the Medical Review Officer that I had only used legal Delta-8-THC products. His response: the test detected THC metabolites, the company policy does not differentiate between legal and illegal sources of THC, and the result stands. Job offer rescinded.
I later learned that THC metabolites from Delta-8 are stored in fat and can persist for weeks with repeated use. Five days was nowhere near enough. I also learned that most employers do not distinguish between Delta-8 and Delta-9 for drug testing purposes — and there is currently no widely available confirmatory test that reliably differentiates the two.
If you are subject to any form of drug testing — employment, probation, military, sports — treat Delta-8 exactly like you would treat marijuana. It will show up. The fact that it is legal where you bought it is irrelevant to the testing protocol.
I eventually found another position, but it took three additional months. An expensive lesson.
